Provisions for Data Protection and Data Collection
We distinguish between the protection of your data, which we treat and process as an asset of the utmost importance, and the collection of data for the provision of our services as well as the collection of log data for the evaluation and use of this website and our technical services, as follows:
Personal data
Your personal details, including address, email and telephone numbers, are carefully stored and are not commercially traded by us. In order to fulfil the order, in particular when it involves a third-party service provider such as a Delivery Service for Physical Goods, your contact details will be made available to third-party companies such as DHL, DPD or FedEx to name a few. For all Services PVY.swiss is offering, your data is not being shared with anybody.
Creation of profiles, data collecting and mining
Offers, invoices, payments, and the itemized list of connections in accordance with statutory requirements as a service provider, as well as any correspondence with us will be stored related to personal contact data, and linked to your PVY.swiss account.
Your surfing history, either in your function as an SaaS Access customer or as a visitor to our website, will not be indexed or linked to your personal account.
Website Analytic, cookies and logging
To process your order, shopping cart or ticket in technical terms, we, like all website operators, rely on cookies with a half-life of 6 weeks, to ensure that your shopping cart, project, collective offer, lists etc. will be maintained accordingly. However, we also have tokenized Logins which do not require cookies anymore. We are constantly implementing these Web 3 Standards for user privacy.
Furthermore, we do not rely on Google Analytics Tracking or any outside of our Datacenter used Cloud Monitoring to improve the user-friendliness of our website. For Website Analytics we use our own tools and open source solutions. No personal data will be stored with this service. This means that there is no flow of IP data to the outside world, as well no user data.
PVY.swiss records the minimum that we are required to log as a SaaS service provider to ensure the availability and quality of our own services. No logs with personal data are created; we use system logs to secure our services. We regard you as a paying customer that receives a service, not a product that we need to monetise.
For Status Monitoring of our Services, Main Websites and Landing Page, we use pure open source or own solutions, such as:
- Kuma Uptime
- PVYanalytics
- PVYapplytics
- checkMK
We do not track user and do not link data to personal accounts. We also do not set a cookie, except on eCommerce Check-out for the Payment Processors, since there its required. We focus with Monitoring to ensure our service and usability improvements. Data harvesting is not our business model.
No Phoning Home Policy
PVY is an acronym for Privacy. None of our Mobile, Desktop or Web Apps, as well as our Hardware Appliance, sends any Data back to us. Not for App Usage Analytics, nor any kind of anonymous Data. We truly believe, that if you produce high quality software, there is no need to harvest data from paying customers. However, in our software development product cycle , we have Beta/Preflight Stages, where we use detailed data Analytics to fix bugs or improve the Software, working with a special beta tester audience. This data analytics capability is removed when we release the application for general use..
Special Remarks for PVY Beta & Preflight Tester
In our Developer Environment, including any Pre-release seeded to our Beta and Preflight Tester Audience, we use our own solution PVYapplytics to gather code failures, long query times and logs. There are no personal data collected, its pure telemetry, logs and traces to improve code and nail issues down. For any Master / Release Candidate, these Analytics are being deactivated. How ever, for development reasons we can activate custom attributes such for failed logins: email-id but not passwords, ip-address from the call, and device informations to help developers to solve problems quickly when they arise.
Built-in Feedback Forms in PVYapps
On most of our Apps, you will find a direct feedback option, which users can use to send general feedback, suggestions for improvement, or in case of a real problem, also report.a bug or unexpected behaviour of the app. By utilising the Feedback Function to send a message to us, Users can optionally attach Logs from the affected device, which helps our Developers to nail down the reported issue. This Submitted Data is anonymous already, does not contain the users personal data or any other sensitive data , and is transferred to us using our secure API Service.
Application and Service Monitoring
We use several available open source solutions to monitor the services provided to customers as a SaaS Service. All monitoring solutions are running on our own infrastructure and not being stored elsewhere in the cloud. Monitoring includes I/O utilisation and uptime availability in addition to other details about the service usage.
PVYmessenger
Our Messenger is based on the open source matrix protocol, which enables decentralised messaging. The base Service for it is provided from our data-center and consists of stun Services and Signaling Servers, to reach the Participants or even the Messaging Server itself, which can be hosted decentralised on PVY@Home or PVY@Office Appliances. Due the Design of Peer-toPeer (P2P) Messaging, which not only encrypts the data flow between users, but also their entire messages and all sent attachments, with a Key based Encryption for P2P Users, and a Key for Private or Public Channels, PVY.swiss has no access to the content of any messages of its users, by design. The same applies to the Administrator of an Home Appliance. There is no master key available to crack the encryption even on the local devices. Each user has their own key and exchange this key for encryption and decryption with each individual user using the built-in Verification Process.
PVY-ID and PVYmessenger Username
When first time logging to our PVYmessenger Services, users authenticate with their PVY-ID, to access the service. However, you will be prompt to choose a unique username/nick name and are free to set your Display Name, how you appear within other participants of the service. The chosen Username is not linked with your personal account given by the PVY-ID to PVY.swiss. It’s truly relays on the Messenger Itself, and PVY-ID is only used as an authentication service against the messenger service, where the tokens for it are stored encrypted on the messenger service itself.
Local find, global decentralised Federate and User lookup
Each user can define by him self, if he can be found over certain identifiers such as a mobile phone number or email address trough other users. By default these fields are empty and user is free to set it. Furthermore, the service also allows, if your users can only be found within your trusted domain or home appliance, or if you want to be found decentralised from other home appliance users as well. This allows the maximum of privacy. However, if you send out an invite to somebody else not on the same environment as you reside in, receiver will be able to join you for a Chat/Call Conversation given by that invite.
Differentiation of Public Channels and Private Channels
Any user, regardless of where they use PVYmessenger as a Virtual Private Cloud Service, or have it running on their Home Appliance, can create and publish private and public channels. Private Channels are encrypted for all joining users, and the channel creator can choose that the channel can be joined via a search or only through invitation and approval. Whereas public channels are not encrypted and anybody can join, optionally with approval from a moderator or the admin of the channel.
Blocking / Banning Users, Reporting of inappropriate messages
Both in Public and Private Channels, users can flag a message or contribution as inappropriate. How these flagged messages are dealt with depend on the Channel owner. The Channel owner can define additional Admins and Moderators for their channels, who then also receive the link and message id, if someone reports or flags a message as inappropriate. The Decisions and Actions taken with respect to reported messages belong solely to the Channel Owner and the Channel Moderators and cannot be viewed or evaluated by PVY.swiss.
A channel can be flagged as Contains adult content“ on its creation, and this will be indicated on Channel Search Results or at the time of joining such a channel to its members. This way users know exactly what they can expect. PVY.swiss has no problems with nudity at all, and we also don‘t have any insights to the content provided by the Channel Owner and channel members.
However, we clearly state, that the law must be respected, especially in terms of content related to the abuse of minors which is a subject for law enforcement in any country. If users report such content to PVY.swiss, the legal team of PVY.swiss is entitled to take all possible measures to support law enforcement and block such users entirely from using their PVY-ID and remove access to all provided applications immediately.
PVYsearch
Each PVY.swiss customer get‘s access to a personalized Search Dashboard under their own Domain for all users within the organization or the associated family members. PVY.swiss does not log search queries of its users or profile user search in any way. The PVY-ID Login is required for reasons such as:· Providing Custom Lenses for each user· Providing Child Protection in searchesThe same applies, if you are using our A.I based Summarizer to break down large content to a summary or using the built-in /grok Service, which is open source as well, fromthe company known as X (formerly known as “Twitter”).
PVYmaps & Geo Location Sharing
Each PVY.swiss customer get‘s access over its PVY-ID to use our own hosted Map Services and Satellite Images. PVYmap Services are built-in client side in PVYmessenger, PVYsearch and PVYbusiness-Suite and rendered fully on the client side, which means within the app of the user.
Users can share their GEO Location with another PVY-ID User in Messenger and just like the encrypted messages, the Location of such user is not revealed to PVY.swiss . PVY.swiss only provides the Map Service, when the client loads the vector and its allocated tiles from our servers over an encrypted connection. The GPS Coordinates remain only on the user devices and if shared with another user or in a private channel, the invited users can see the location of that particular user if they shares their location.
Why we restrict these Maps Services to PVY-ID Users only?
First of all, we do privacy by design. There is no service out there which respects your privacy in the way that PVY.swiss does. Secondly, we run the service based on OpenStreetMap, on our own infrastructure with daily updates. Additionally for more details and accuracy we provide around 2 Billion proprietary map objects on top of OpenStreetMap Data & Cartography Sets and additional High- Definition Satellite Images. All this is done through an underlying non public licensing model, granted to PVY-ID Users only.
General Data Protection Regulation
Based in Switzerland, which generally boasts the strictest privacy and data protection laws in force, we welcome all efforts that lead to better data protection. If you want to improve your personal data protection, take a closer look at some of the free services where your shared content and personal data form the capital.
We offer regulatory data erasure, which the customer can initiate on their own through the customer portal, but wish to point out that we nevertheless comply with the statutory retention obligation under Swiss law for relevant communications and documents. This includes email correspondence, invoices and proof of payment as well as the connection data (CDR) in accordance with the respective minimum statutory requirements, CDRs for a period of six months.
In General we protect all User Data with the strongest measures in the industry and also can state, that technology wise, we implemented in all trough PVY.swiss provided Apps and Services Privacy by Design.
We would also like to point out that PVY.swiss cannot be ordered by a foreign authority or institution to disclose personal data, nor will it comply with such an order, as this would violate Swiss law on the protection of personal identity.
In such cases, a request for legal assistance must be submitted to the official Swiss authorities, who may, according to very strict rules, call in the local authorities to investigate the facts if the offence is serious.
